User Agreement for Jiobindaas Global Private Limited.
You are required to read and accept all the terms and conditions of this agreement and our Privacy Policy to become a user of Jiobindaas. This Agreement does not hold valid for any third-party. You may not use nor access our services if you do not agree to be bound by the terms of this Agreement.
Acceptance & Usage
In order to use the Jiobindaas Services, you can accept the Agreement by
a) Clicking accept or agree at the end of this document OR
b) by actually using the Jiobindaas Services. In this case it will be assumed that you accept the terms of the Agreement
Incase,
a) You do not accept the terms of the Agreement
b) You are younger than the accepted age limit to sign the Agreement, unless accepted also by a parent / legal guardian of acceptable age.
c) You are legally debarred from using Jiobindaas Services under the laws of India.
You may not use Jiobindaas Services.
It is recommended that you print, save a copy of the Terms of the Agreement for your records. Jiobindaas reserves the right to modify the Agreement and Terms and Conditions at any time, with or without prior notice, by publishing modified terms on the website. Your continued use of Jiobindaas reflects your acceptance of the amended Agreement.
Description of Service
Your use of our products, web site and related content, hereby known as “Services” in this document, excluding any other services provided by us in a separate written agreement will be taken as a legal agreement between you and Jiobindaas ( HeadQuarters )
Jiobindaas is an online service which provides the following
a) Online service enabling professionals to locate and establish connections with other professionals for a job change, contract or business deal or general information and help
b) Ability to synchronize your mobile phone with the Jiobindaas server.This enables you to
1. Manage your phone’s content to / from your phone with our server.
2. Create backup of the content and synchronize it with your existing / new phones
3. Share contents with your phone / PC and other supported devices
Membership Eligibility
Jiobindaas Services is available only to users of age 14 or above. Users are recommended not to have more than one active account. Your Jiobindaas account is non-transferable under any circumstances.
RESPONSIBILITY FOR USAGE AND SECURITY
By your initial and continued usage of Jiobindaas Services it is implied that you are in agreement with the terms and conditions, and in addition, agree to
a) Protect and maintain the security and confidentiality of your password and account
b) You are responsible (and that Jiobindaas has no responsibility to you or any third party) of any activities that occur under your account with or without your knowledge
c) You will contact and inform Jiobindaas as soon as you learn of any breach of security to your account like hacking, malicious usage of your account. Jiobindaas will have no responsibility or liability for any loss of information, wrong usage of your data due to the above.
d) You will not in any way – copy, duplicate or resell any of Jiobindaas Services for any purpose unless you have a separate written agreement with Jiobindaas
e) You will not impersonate any other person’s name / identity in any way unless authorized by that person
Jiobindaas reserves the right to disable any or all of the services provided to you or any other user without prior notice for any or no reason.
Termination
Jiobindaas has the right to temporarily or permanently disable, disconnect any services provided to you with or without prior notice.
In addition any instance of the below will automatically lead to a termination of your Jiobindaas Account
a) Any misleading / false information provided at the time of registration, either intentionally or unintentionally
b) Any violation of the terms and conditions of the User Agreement at any point of time
c) Personal request by you to terminate / disable any or all services provided by Jiobindaas
d) Exceeding permissible period of account inactivity by you (twelve months) for any reason. A warning e-mail may or may not be sent to you before the closure of your account and Jiobindaas will have no liability for any loss / damage to you or any other third party resulting in the termination of your account for whatsoever reason(s)
e) Legal issues require Jiobindaas to terminate your account
Jiobindaas also reserves the right at anytime to shutdown any or all of its services provided with or without prior notice and with or without reason.
User Conduct
Welcome to Jiobindaas, you can use our services after you sign-up for them and the User Agreement. It is your onus to ensure the information you share using our Services is legal in the country you live or access Jiobindaas.
By signing the Agreement you agree to the following
- You are solely responsible for any information, pictures, text and other personal / public data you publish using our Services.
- You are not allowed to post any illegal, libelous, abusing, sexual, obscene, racist, or any derogatory text, picture, video or other media used in our services
- You will not publish any public or private information of any third party excluding their names and including any other information like address, telephone numbers, e-mail addresses, credit card numbers etc
- You will not furnish any information you do not have legal authority to broadcast under any law or under contractual or fiduciary relationships (such as insider information, or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
- You will not use Jiobindaas Services to make available any content or initiate communication that infringes upon patents, trademarks, trade secrets, copyrights or other proprietary rights.
- You will not publish any data which violates copyright information, be it in text, visual or AV format.
- Any of Jiobindaas Services will not be used by you in any manner for any illegal activities and communicate towards any unlawful flow of information, like instigate malicious or terror related activities, harassment of any third party person and any other activity which is legally disallowed.
- You will not utilize Jiobindaas Services for any SPAM or related activities like unsolicited bulk messaging by SMS , MMS , E-Mail and / or any other kind of messaging.
Global Laws
Since Jiobindaas Services are based out of the internet; you will need to comply with online code of conduct and content in addition to the laws of your country and of India.
Information Content License on this Website
While using the Jiobindaas Service, users may provide information about themselves which may be visible to certain other users (see our Privacy Policy to learn more about information collected on this website).
- Jiobindaas gives you a personal, worldwide, royalty-free, non-transferable and non-exclusive license to use our Services provided to you subject to the terms and conditions of the Agreement
- You are not permitted in any manner to knowingly or unknowingly use any of the Jiobindaas web based software application unless permitted or required by law or in a separate written agreement with Jiobindaas.
- Any information published on Jiobindaas website or any other of our Services grants Jiobindaas a perpetual, irrevocable, worldwide and royalty-free license by you to use this information to reproduce, modify, and broadcast any content.
- All information posted or transmitted using Jiobindaas Services is solely the responsibility of the originator and Jiobindaas will have no liability or responsibility towards any content, its authenticity, errors and other omissions.
Access to Service
Use of any manual or automated software, devices, or other processes to “crawl” or “spider” any web pages contained in the Jiobindaas website is strictly prohibited otherwise provided directly by Jiobindaas. You agree not to monitor or copy, or allow others to monitor or copy, our web pages or the content included herein. You are not allowed to duplicate or otherwise simulate the appearance or function of this website. Furthermore, you agree not to take any action that interferes with the proper working of or places an unreasonable load on our infrastructure, including but not limited to unsolicited communications, attempts to gain unauthorized access, or transmission or activation of computer viruses.
Jiobindaas Communications
Jiobindaas may need to communicate with you from time to time, over e-mail and / or SMS. By accepting the User Agreement you agree to receive such communication which are specific to your account and required by us for the normal functions of Jiobindaas
Monitoring and Enforcement
Jiobindaas has a non-obligatory right to monitor the content on Jiobindaas Services. However since Jiobindaas may or may not have the ability to control or actively monitor the information on it’s websites Jiobindaas cannot guarantee the authenticity, accuracy and quality of the contents.
You may contact our Customer Service (hyperlink) for any violations of the content or any content you feel is offensive, malicious or objectionable in any way. However Jiobindaas reserves the right to take or not to take any action and will no ways be held responsible for any loss or damage caused to you due to any of the content published and it’s access.
ADVERTISERS
Jiobindaas services may contain advertisements which are utilized by Jiobindaas for it’s commercial interests. Your agreement to Terms and Conditions implies your acceptance to allow advertisements to be displayed in any or all of Jiobindaas web sites. Jiobindaas does not guarantee or take responsibility of the advertisements in any way and users may approach the advertisements at their own risk.
Fees
All basic services of Jiobindaas are totally free of cost; however premium services can be availed by you at cost.
Indemnification
By accepting this User Agreement, you agree to indemnify and otherwise hold harmless Jiobindaas Global Private Limited, its officers, employees, agents, subsidiaries, affiliates and other partners from any direct, indirect, incidental, special, consequential or exemplary damages resulting from i) your use of the Jiobindaas Service; ii) unauthorized access to or alteration of your communications with or through the Jiobindaas Service, or iii) any other matter relating to the Jiobindaas Service. Any business transactions which may arise between users from their use of Jiobindaas are the sole responsibility of the users involved.
Without limitation of the terms and conditions set forth in our Privacy Policy, you understand and agree that Jiobindaas may disclose personally identifiable information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to comply with legal process, enforce this User Agreement, or protect the rights, property, or safety of Jiobindaas, its users, and the public.
Disclaimer of Warranties
JIOBINDAAS AND ITS SERVICES IS OWNED AND PROMOTED BY JIOBINDAAS GLOBAL PRIVATE LIMITED
YOU UNDERSTAND AND AGREE THAT THE JIOBINDAAS SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND THAT JIOBINDAAS DOES NOT ASSUME ANY RESPONSIBILITY FOR PROMPT OR PROPER DELIVERY, OR RETENTION OF ANY USER INFORMATION OR COMMUNICATIONS BETWEEN USERS. JIOBINDAAS ASSUMES NO RESPONSIBILITY FOR THE ACCURACY OR EXISTENCE OF ANY COMMUNICATIONS BETWEEN USERS. JIOBINDAAS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
JIOBINDAAS MAKES NO WARRANTY THAT (i) THE JIOBINDAAS SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE JIOBINDAAS SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE JIOBINDAAS SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE JIOBINDAAS SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE JIOBINDAAS SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM JIOBINDAAS OR THROUGH OR FROM THE JIOBINDAAS SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS USER AGREEMENT.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
Entire Agreement
The User Agreement constitutes the entire agreement between you and Jiobindaas and governs your use of the Jiobindaas Service, superseding any prior agreements between you and Jiobindaas.
Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT JIOBINDAAS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF JIOBINDAAS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT WILL JIOBINDAAS’S TOTAL CUMULATIVE DAMAGES EXCEED US$ 10 OR INR 500.
Governing Law
The User Agreement between you and Jiobindaas Global Private Limited will be governed by and construed in accordance with the laws of Gurgaon, India without regard to conflict of laws principles.
General Information
Jiobindaas, the Jiobindaas logo, and other Jiobindaas logos and names are trademarks of Jiobindaas Global Private Limited. You agree not to display or use these trademarks in any manner without Jiobindaas’ prior, written permission.
